Terms of Service

1. Agreement to these terms

Ensō is provided by Raintree Forge LLC ("Raintree Forge", "we", "us"). These terms are a binding agreement between you and Raintree Forge LLC. By creating an account or using Ensō — the web app at app.ensoapp.io, the desktop and mobile apps, and this website — you accept them. If you don't agree with them, don't use the service.

You must be at least 13 years old (or the minimum age required to consent to online services in your country, if higher) to use Ensō.

2. The service

Ensō is a personal productivity suite — todos, calendar, reading list, projects, notes, and email — that syncs across your devices and works offline. It's available as a web app, desktop apps, and a mobile web app.

Ensō is actively developed. We work hard to keep it reliable, but features may change, be added, or be removed as the product evolves. We'll give reasonable notice before removing or materially degrading a core capability you rely on.

3. Your account

  • Provide accurate registration information and keep it up to date.
  • Keep your password (and any vault passwords) confidential. You're responsible for all activity under your account.
  • Accounts are for one person. Don't share an account or transfer it to someone else.
  • Tell us at contact@raintree.dev promptly if you believe your account has been compromised.

4. Your content

Everything you put into Ensō — tasks, notes, events, saved pages, projects, mail, all of it — is yours. We claim no ownership of your content.

So that the service can function, you grant us a limited, non-exclusive license to host, store, transmit, back up, and display your content — solely to provide, sync, and safeguard the service for you. This license ends when you delete the content or your account, except for residual copies in backups, which age out on the schedule described in our Privacy Policy.

Content in an end-to-end encrypted vault is stored by us only as ciphertext; we cannot read it, and — as the app warns you when you create a vault — we cannot recover it if you lose both the password and the recovery code.

You're responsible for the content you store. Don't store content you don't have the right to store.

5. Acceptable use

Don't misuse the service. In particular, you agree not to:

  • use Ensō for anything illegal, or store content that's unlawful to possess or distribute;
  • probe, disrupt, or overload the service, bypass rate or storage limits, or interfere with other users' use of it;
  • access the service by automated means at abusive volume, or resell, rent, or offer the service to third parties;
  • attempt to gain unauthorized access to any account, system, or data that isn't yours;
  • reverse engineer, decompile, or disassemble the service or apps, except to the extent a law expressly permits it despite this restriction;
  • use the service to send spam or distribute malware.

If you find a security vulnerability, we'd genuinely appreciate a report to contact@raintree.dev — please give us a reasonable chance to fix it before disclosing it publicly.

6. Plans, billing & cancellation

Ensō has one paid plan, Premium (see Pricing), which every new account can try free for 14 days. These terms cover how it works:

  • Free trial. Every new account gets a 14-day trial of Premium with no payment details required. When the trial ends without a subscription, your data remains on your devices and on our servers, but sync across devices is paused until you subscribe.
  • Subscriptions renew automatically (monthly or yearly, as chosen) until canceled. Payment is handled by Stripe, a third-party payment processor; we don't store your card details.
  • Cancel any time. Cancellation takes effect at the end of the current billing period; you keep paid features until then.
  • Refunds. Except where the law requires otherwise, payments are non-refundable and we don't prorate partial periods — but if something went wrong, contact us and we'll be reasonable.
  • Price changes take effect no earlier than your next billing period, and we'll notify you at least 30 days in advance.
  • Applicable taxes may be added to the listed price.
  • If a payment fails, we may pause sync for the account after a grace period; your data is not deleted for non-payment.

7. Termination

You can stop using Ensō and delete your account at any time; this deletes your server-side data as described in the Privacy Policy.

We may suspend or terminate an account that materially violates these terms, creates risk or legal exposure for us or other users, or has been inactive for an extended period on a free plan. Except where the violation is severe or notice is legally restricted, we'll notify you and give you a chance to export your data first.

Sections 4 (license ending aside), 8, 9, 10, and 12 survive termination.

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF DATA LOSS. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN COPIES OF DATA YOU CANNOT AFFORD TO LOSE (THE DESKTOP AND WEB APPS EACH KEEP A FULL LOCAL COPY, AND EXPORT IS AVAILABLE).

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAINTREE FORGE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, GOODWILL, OR DATA, ARISING OUT OF OR RELATING TO THE SERVICE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) US $50 AND (B) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions don't allow certain limitations of liability, so parts of this section may not apply to you; in that case our liability is limited to the smallest extent the law allows.

10. Indemnification

You'll indemnify and hold Raintree Forge LLC harmless from claims, damages, and reasonable expenses (including attorneys' fees) arising from your content, your use of the service, or your violation of these terms or of someone else's rights.

11. Changes to these terms

We may update these terms as the service evolves. For material changes we'll give notice — by email or in the app — at least 14 days before they take effect. Continuing to use Ensō after a change takes effect means you accept the updated terms; if you don't, stop using the service and delete your account. The current version is always at ensoapp.io/terms/.

12. Governing law & disputes

These terms are governed by the laws of the State of Missouri, USA, without regard to conflict-of-laws rules. Any dispute that can't be resolved informally will be brought exclusively in the state or federal courts located in Missouri, and both parties consent to their jurisdiction. Before filing anything, please email us — most issues can be sorted out directly.

If a provision of these terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision isn't a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between you and us regarding the service.
